Terms of Service

Effective: April 21, 2026

These Terms of Service ("Terms") govern your access to and use of the Call Mabel website and the Call Mabel service (collectively, the "Service"). By using any part of the Service, you agree to these Terms. If you subscribe as a paying customer, the Service Agreement also applies and controls where there is any conflict.

1. Eligibility

You must be at least eighteen (18) years old to create an account or subscribe to the Service. You represent that you have the legal capacity to enter into this agreement.

2. Account Registration

If you create an account, you agree to provide accurate, current, and complete information and to keep that information updated. You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.

3. Acceptable Use

You agree NOT to:

• Use the Service for any unlawful, harmful, fraudulent, or infringing purpose
• Attempt to gain unauthorized access to any part of the Service or related systems
• Reverse-engineer, decompile, or disassemble any AI models or proprietary technology
• Scrape, harvest, or automatically extract data from the Service without written permission
• Impersonate any person or entity, or misrepresent your relationship to any End User
• Send spam, viruses, or malicious content through the Service
• Record or redistribute Mabel's conversations without the consent of all parties, where required by law
• Use the Service to harass, threaten, or harm any person

4. Intellectual Property

All content, software, designs, logos, trademarks, AI models, and other materials made available through the Service are owned by Call Mabel or its licensors and are protected by intellectual property laws. You receive a limited, revocable, non-transferable license to access and use the Service for personal, non-commercial purposes.

You retain ownership of content you provide to Call Mabel (such as personal stories, family information, or documents you upload), but you grant Call Mabel a limited license to use that content as necessary to provide the Service.

5. User-Generated Content

You are solely responsible for any content you provide to Call Mabel, whether through a phone call, an uploaded document, a family dashboard entry, or otherwise. You represent that you have the right to share that content and that it does not violate any law or third-party right.

6. Third-Party Services and Links

The Service may integrate with or link to third-party services (for example, Stripe for payments, Resend for email, ElevenLabs for voice synthesis, Supabase for data storage). Your use of any third-party service is governed by that service's own terms. Call Mabel is not responsible for third-party services.

7. Termination

Call Mabel may suspend or terminate your access to the Service at any time, with or without cause, and with or without notice, if we reasonably believe you have violated these Terms, the Service Agreement, or applicable law; if we are required to do so by law; or if continuing to provide the Service to you poses a risk to Call Mabel or other users. You may cancel your subscription at any time per the Service Agreement.

8. Modifications to the Service

Call Mabel may modify, suspend, or discontinue the Service (or any feature of it) at any time. Where reasonably practical, we will provide advance notice of material changes.

9. Warranties and Liability

The disclaimers of warranties and limitations of liability set forth in the Service Agreement apply equally to these Terms. The Service is provided "as is," without warranty of any kind, and Call Mabel's liability is strictly limited as described in Section 5 of the Service Agreement.

10. Governing Law and Disputes

These Terms are governed by the laws of the State of Florida, without regard to conflict-of-law principles. The dispute resolution and arbitration provisions of Section 11 of the Service Agreement apply.

11. Changes to these Terms

Call Mabel may update these Terms from time to time. Material changes will be notified by posting the updated Terms at this URL with a revised effective date. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
